JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with G.O. Case No. 1331 of 2019, arising out of P.R. Case No. 35 of 2019 registered for offence punishable under section 30 (a) of the Bihar Prohibition and Excise Act. Allegation has been made that about 05 litres of country made liquor and 250 litres of raw materials for manufacturing of liquor have been recovered from the house of the petitioner Learned counsel for the petitioner submits that the

Considering the aforesaid facts, the petitioner, named above, is directed to be released on bail on his personal bond to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Excise, Darbhanga, in connection with G.O. Case No.1331 of 2019, arising out of P.R. Case No. 35 of 2019, subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
