Petitioner seeks bail in Sessions Trial No.442 of 2018 arising out of Manihari P.S. Case No.193 of 2018 instituted for the offence under Section(s) 302 Indian Penal Code and Section 27 of the Arms Act pending in the Court of the Sessions Judge, Katihar.
It is alleged that this petitioner fired from rifle on husband of the informant, which hit on his chest and he died on the spot. Deceased was own son of the petitioner. Occurrence took place due to land dispute.
Case diary has been received, wherein, postmortem report is available. Doctor has opined that death has been caused due to firearm injuries. One wound of entry and one wound of
Patna High Court CR. MISC. No.17797 of 2019(5) dt.01-08-2019 2/2 exit was found on person of the deceased.
Therefore, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected at this stage.
