The petitioner apprehends his arrest in Ara Muffasil P.S. Case No.382 of 2020 registered under Sections 341, 323, 324, 308 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. It is further submitted that the name of the petitioner has surfaced in this case merely on the basis of land dispute. The petitioner has got no criminal antecedent.

Learned A.P.P. for the State has opposed the prayer for bail by contending that the petitioner along with other accused persons are alleged to have struck with sharp edged weapon on the head of the informant and his brother and when the mother

Patna High Court CR. MISC. No.23121 of 2021(7) dt.26-04-2022 2/2 of the informant came to save, she was also assaulted by them. As a result of which, they sustained injuries which is supported by the injury report. Therefore, the petitioner does not deserve anticipatory bail.

Having considered the facts aforesaid, this Court is not inclined to enlarge the petitioner on anticipatory bail. Accordingly, his prayer for bail is rejected. Harish/- (Arvind Srivastava, J) U T
