On the basis of the contents of the First Information Report, a cognizable offence is made out. The First Information Report, therefore, cannot be quashed in exercise of power under Section 482 of the Code of Criminal Procedure. Learned counsel for the petitioner submits that no offence is made out against him and he has been falsely implicated in this case. He has also been submitted that the petitioner has filed his representation before the Superintendent of Police,
Patna High Court Cr.Misc. No.31659 of 2013 (2) dt.08-03-2016 Supaul as well as the Investigating Officer.
The Court expects that if any document has been filed by the petitioner before the Investigating Agency, the Investigating Agency may look into those documents for the purpose of proper investigation.
This application stands disposed of with the observation as aforesaid.
