Petitioner, in the present case, is seeking regular bail in connection with Kotwali P.S. Case No. 29 of 2017, registered for the offences punishable under Sections 379, 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that the allegation against the petitioner is that of committing theft of purse from the bag of the informant. It is alleged that Rs. 5,000/- and another document were kept in the purse. Learned counsel submits that considering the fact that the petitioner has no criminal antecedent and he is in custody since 18.1.2017, an opportunity may be given to the petitioner to mend by granting privilege of bail.
Patna High Court Cr.Misc. No.28550 of 2017 (2) dt.07-07-2017 Considering the facts and circumstances particularly that the petitioner has no criminal antecedent and the petitioner has already remained in custody for about six months, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-Patna, in connection with Kotwali P.S. Case No. 29 of 2017, subject to condition, that one of the bailors should be a family member of the petitioner.
