The petitioner intended to get a sale document registered and for which the Court fee/stamp amounting to Rs. 23,550/- was purchased. The document could not be presented for execution. The petitioner now wants refund of the said amount. The writ application prays for a direction for refund of the said amount of Court fee.
A counter affidavit has been filed in which it has been stated that for such refund, the petitioner is required to institute a proceeding before the competent authority under the instant provisions of law.
The writ application stands disposed of permitting the petitioner to approach the competent authority and file a
Patna High Court CWJC No.14506 of 2013 (2) dt.16-03-2016 2/2 proceeding seeking refund of the amount of Court fee purchased for registration of the document, if not already so filed. If any such proceeding is filed the competent authority of the respondent State shall pass appropriate orders thereon without unnecessary delay in accordance with law.
