JUSTICE SUDHIR SINGH ORAL ORDER 02-07-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 436 and 429/34 of the Indian Penal Code.

The allegation against the petitioners is of setting fire in palani. It is further alleged that in the occurrence two cows sustained burn injuries and calf of the informant succumbed to its burn injuries.

It has been submitted on behalf of the petitioners that the petitioners have no criminal antecedent. From perusal of FIR it would appear that no specific allegation has been made against the petitioner. It is further submitted that omnibus and general allegation has been made. It is also submitted that no overt act is

Patna High Court Cr.Misc. No.17060 of 2015 (3) dt.02-07-2015 2/2 said to have been alleged against the petitioners in the FIR. It is further submitted that Title Suit No.110 of 2014 is pending in the court below between the parties.

On behalf of the State nit has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Gopalganj, in connection with Gopalganj Town P.S.Case No. 6 of 2015 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
