The petitioner seeks regular bail in connection with S.T.No.199 of 2018 arising out of Bhhaptiyahi P.S.Case No.32 of 2018 , registered for offences punishable under Sections 341, 323, 302, 34 of the Indian Penal Code.

FIR discloses the allegation of assault against the petitioner and one co-accused by lathi on deceased. Submission of the learned counsel for the petitioner is that the FIR itself shows that the deceased was not taken to hospital on the advice of his Gotiya, due to which he succumbed to the injuries and the co-accused Kamlakant Singh against whom there is allegation of assault has been granted bail, vide order dated 6.11.2018 passed in Cr. Misc. No.58177 of

Patna High Court CR. MISC. No.13108 of 2019(5) dt.20-05-2019 2/2 2018. Petitoner has no criminal antecedent and he is in custody for about ten months.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge 3rd, Supaul in connection with S.T.No.199 of 2018 arising out of Bhaptiyahi P.S.Case No.32 of 2018. With the above direction, this application is allowed.
