The petitioner seeks bail in Bhagalpur Rail P.S. Case No. 27/2016, registered for the offences punishable under Sections 394, 307 and 411 of the Indian Penal Code as well as Section 27 of the Arms Act.
The informant alleged that his money was taken out from his pocket. When he enquired, the petitioner along with other co-accused assaulted him. When the sister of the informant came to save, she was also assaulted by the accused persons. Two persons are alleged to have been apprehended by the passengers and one person fled away from the running train. One of the accused persons made firing. The apprehended accused
Patna High Court Cr.Misc. No.28768 of 2017 (2) dt.11-07-2017 2/2 persons disclosed their name as Anand Goswami and Kanhaiya Sah. They also disclosed the name of the petitioner as Pawan Goswami, who managed to flee away from the running train. It has been submitted that other co-accused persons have already been enlarged on bail. The petitioner is in jail since 16.04.2016. He has already remained in custody for 15 months. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 4th Additional Sessions Judge, Bhagalpur in connection with Bhagalpur Rail P.S.
