Petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

According to F.I.R., four persons, including the petitioner brought the dead body of the father of the informant at the gate of the informant in the night. The petitioner and others were identified by the informant. The informant claims that murder of the father was committed with intent to grab his money and to falsely implicate the family members of the informant in a criminal case.

The wife of the deceased had also filed Complaint

Patna High Court CR. MISC. No.12059 of 2019(3) dt.07-05-2019 2/2 Case No.C-75 of 2019 against the informant of this case and others to be involved in commission of murder of her husband. On the basis of that complaint, a case was registered as Dhanaha Police Station Case No.29 of 2019.

Considering the conflicting version of occurrence on the record, a co-ordinate Bench of this Court has granted bail to co-accused, Hirala Kushwaha in Criminal Miscellaneous No.1060 of 2019. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Dhanaha Police Station Case No.207 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
