Heard learned counsel for the petitioner and counsel for the State.
The petitioner apprehends his arrest in Mohammadpur P.S. Case No. 195 of 2019 registered for the offence punishable under Section 304/34 of I.P.C. Prosecution case is that on 14.11.2019 mother of the informant had died because of negligency of the petitioner who was treating his mother at the relevant time. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further
Patna High Court CR. MISC. No.11183 of 2020(2) dt.17-06-2020 2/2 submitted that the petitioner is a qualified doctor and in fact he never treated the mother of the informant. The post mortem report shows that there was no external or internal injury of the victim. Petitioner has got clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st A.C.J.M., Gopalganj in connection with Mohammadpur P.S. Case No. 195 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) SONALI/- U T
