JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 17-02-2018 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
In this application for anticipatory bail the petitioner apprehends his arrest in connection with Bettiah Town P.S. Case No. 813 of 2017 for the offences punishable under sections 324, 307, 387, 379 and 427 of the I.P.C.
Allegedly, the petitioner being in drunken state at the point of knife demanded ransom of Rs. 5,000/- per month from the informant, driver of Ambulance, damaged glass and when the informant tried to flee away he gave knife blow which hit temple and when again the petitioner tried to repeat the blow he was pushed back and the informant succeeded in fleeing away. From the dickey of the Ambulance chalan book and cash of Rs. 5,500/-
Patna High Court Cr.Misc. No.8040 of 2018 (2) dt.17-02-2018 2/2 were found missing. Earlier also the petitioner has demanded ransom.
Submission is of false implication and that the informant has received simple laceration caused by hard and blunt substance over left pinna, vide Annexure-2, and moreover the case has been compromised and the informant has filed compromise petition with the anticipatory bail petition in the court of the District & Sessions Judge, West Champaran, Bettiah, vide Annexure-3.
The learned A.P.P. fairly submits that now matter has been compromised.
In the facts and circumstances stated above, the petitioner, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M, Bettiah, West Champaran in connection with the aforementioned case, subject to the condition as laid down under section 438 (2) of the Cr.P.C.
