This application for anticipatory bail arises out of Tarabari P.S. Case No. 09 of 2016 for the offence under Sections 406, 409 and 420/34 of the Indian Penal Code. The First Information Report has been registered with the allegation of leaving the construction of a school building incomplete even after having received the fund, released for the said purpose.

The petitioner is Secretary of the Shiksha Samiti of the Gram Panchayat, under which the school is located. My attention has been drawn to an order of this Court dated 14.05.2018 passed in Cr. Misc. No.8509 of 2018, which was filed by the Principle of the School, in which, it has been recorded that as per report of the informant and Engineers involved in the construction work, the construction has now

Patna High Court CR. MISC. No.17609 of 2019(2) dt.26-03-2019 2/2 been completed. The Principal has been allowed regular bail by this Court on that ground by the said order dated 14.05.2018. Considering the aforesaid circumstance, this application is allowed.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M. 1st Class, Araria in Tarabari P.S. Case No. 09 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
