Heard counsel for the parties.

The petitioner apprehends his arrest in Bathanaha P.S. Case No. 130 of 2018, registered for the offences punishable under Section 302/34 of the Indian Penal Code. It is alleged that the accused persons including this petitioner committed murder of the brother of informant for grabbing his property.

It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case. There is no eye-witness of the occurrence. There is general and omnibus allegation

Patna High Court CR. MISC. No.11613 of 2020(3) dt.28-08-2020 2/2 against him. Petitioner has got no criminal antecedent. Learned APP vehemently opposed the prayer for bail and submitted that from the postmortem report is appears that altogether six injuries found on the person of deceased caused by hard and blunt substance.

Considering the facts aforesaid and nature of allegation, I am not inclined to enlarge the petitioner abovenamed on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) vinita/- U T
