JUSTICE SHIVAJI PANDEY ORAL ORDER 27-08-2020 Heard learned counsel for the petitioner and learned APP for the State through Virtual Court Proceeding. In this case, the petitioner is seeking regular bail in connection with NDPS Case No.05 of 2019, arising out of Sheosagar (Baddi O.P.) P.S. Case No.44 of 2019, registered for the offence under Section 8(b), 18 and 20(A) of the NDPS Act. On secret information the Police along with Circle Officer raided the field, where opium has been cultivated, that was seized and the weight has also been mentioned as 70 Kg. Learned counsel for the petitioner submits that the petitioner has wrongly been framed in this case as the land where this seizure has been made does not belong to this petitioner.

Patna High Court CR. MISC. No.11483 of 2020(4) dt.27-08-2020 2/2 Considering the fact that it is the plantation of the opium, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the petitioner may renew his prayer for bail after completion of one and half years of jail custody.
