====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-07-2024 Heard learned counsel for the petitioner and the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 323, 308, 379, 384, 448, 504, 506/34 of the Indian Penal Code.

3. According to F.I.R., this petitioner hit on the head of son of the informant with iron rod and took away Rs. 50,000/- and some jewellery.

4. It is submitted that both parties are gotiyas and out of some petty dispute between them, this false and concocted case has been lodged against the petitioner. Injuries allegedly caused by this petitioner are simple in nature. Rest of the allegations are ornamental only to make the case grave. Petitioner claims clean antecedent.

5. Considering the backdrop of the case, simple injury

Patna High Court CR. MISC. No.21730 of 2024(5) dt.08-07-2024 2/2 and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Bachhawara P. S. Case No. 55 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
