Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour his undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office.

The petitioner is apprehending his arrest in connection with Rajapakar P.S. Case No. 145 of 2020 for the offence registered under Sections 413, 414 and 34 of the Indian Penal Code. The prosecution case as per the First Information Report is that the informant alleged that on 04.07.2020 he came to know that some miscreants were gathered in the bathn of Gaurav Singh, where stolen motorcycle and Tata Safari were kept and they were opening their parts. On information, police party reached there. On seeing the police party, miscreants started to flee away and could not be caught

Patna High Court CR. MISC. No.23049 of 2021(2) dt.05-01-2022 2/2 by the police due to rain. The police recovered some vehicles from the Bathan of Gaurav Singh in presence of two independent witnesses.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He was not apprehended on the spot. Nothing has been recovered from the conscious and constructive possession of the petitioner. It is further submitted that the petitioner has got no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IInd, Vaishali at Hajipur in connection with Rajapakar P.S. Case No. 145 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
