06-03-2019 Heard Sri Pawan Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. This is the 2nd attempt for grant of bail on behalf of the petitioner, who is in custody since 07-05-2018 in Bhagwanpur (Belaon) P.S. Case No. 91 of 2018 registered for offence under Sections 147, 148, 149, 323, 307, 332, 333, 353, 427 of the Indian Penal Code, 1860.

Learned counsel for the petitioner submits that earlier, while rejecting the prayer for bail, this Court had observed to renew the prayer for bail after completing nine months in custody. Accordingly, after completion of nine months in custody, the petitioner has filed the present petition. It has further been argued by learned counsel for the petitioner that

Patna High Court CR. MISC. No.12560 of 2019(2) dt.06-03-2019 2/2 investigation in this case against others is still going on, so there is no possibility of early commencement of trial in the present case.

In view of last observation of this Court as well as the fact that investigation in respect of other accused is still going on, there is no reason to further detain the petitioner. Let the petitioner namely Vakil Paswan be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Kaimur at Bhabua in connection with Bhagwanpur (Belaon) P.S.
