JUSTICE ARUN KUMAR ORAL ORDER 19-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Shambhuganj PS Case No. 156 of 2017 registered under Sections 457 and 380 of the IPC.

The allegation in brief is that the petitioner is said to have committed theft in the house of the informant, identified in the flash of torchlight by the informant and his sleepers and mobile were also found in the house.

Learned Counsel for the petitioner submits that the petitioner was earlier employed as a tractor driver of the informant and he left doing the job, which has come during investigation, and therefore has falsely been implicated in this case, the case was lodged after four days delay having no recovery of stolen articles, besides this he has clean antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Chandan Kumar Yadav @ Chandan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Banka in connection with Shambhuganj PS Case No. 156 of 2017.
