Heard learned counsel for the petitioner and learned APP for the State.

The petitioner in the present case is seeking modification of the order dated 15.10.2020 passed in Cr. Misc. No. 25980 of 2020 which relates to the period of arrest/surrender of the petitioner within four weeks. Learned counsel for the petitioner submits that earlier the petitioner was granted pre-arrest bail by this Court in connection with Industrial Area P.S. Case No. 80 of 2019

Patna High Court CR. MISC. No.15832 of 2022(2) dt.28-09-2022 2/2 registered for the offences under Sections 406, 409, and 420/34 of the Indian Penal Code to the satisfaction of C.J.M, Bhagalpur and was directed to surrender before the learned court below within four weeks from the date of the order but he could not comply with the order due to Covid 19 situation. Learned APP for the State has not opposed the prayer of the petitioner.

Having regard to the submission that due to Covid 19 situation the petitioner was unable to move out from Purnea to reach Bhagalpur, the petitioner could not take appropriate steps to furnish the bail bond within the given period, this Court directs that in case the petitioner surrenders and furnishes the bail bond within six weeks from today, he will get the privilege of anticipatory bail in terms of the order dated 15.10.2020 passed Cr. Misc. No. 25980 of 2020.

This application stands disposed of accordingly. Certified copy of the order will be made available only after removal of the defects.
