The petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273 and 414 of the Indian Penal Code and Section 30(a) of the Excise Act, 2018. The learned counsel for the petitioner submits that the petitioner is in custody since 09.01.2022, he is a person with clean antecedent and charge-sheet has been submitted in the case.
Allegation is of recovery of 1125.36 litre of liquor from a Hyundai car.
The learned counsel for the petitioner submits that the petitioner was not arrested from the spot and he came to be arrested based on suspicion as the vehicle carrying the liquor
Patna High Court CR. MISC. No.14049 of 2022(2) dt.29-03-2022 2/2 was found near the house of the petitioner.
The learned A.P.P. for the State opposes the bail application.
Considering the fact that the petitioner is in custody, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tisiauta P. S. Case No.86 of 2021.
The application stands allowed.
