Petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. Motorcycle of the informant was stolen away by some unknown person. The same was recovered from the road side. Allegation is that in fact the petitioner was driving the said motorcycle and he met with an accident thereafter left the motorcycle and fled away.

Submission is that the petitioner is in custody since 18.11.2017. Investigation of the case is already complete. The petitioner has got no criminal antecedent. Only suspicion is there because petitioner was not arrested at the spot nor there is direct evidence to have seen the petitioner driving the said

Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Beldoour Police Station Case No. 231 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
