JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-03-2019 The petitioner has a grievance that though she filed an application on 22.11.2018 for mutation of her name in respect of a piece of land before the Circle Officer, Udwantnagar Circle in the district of Bhojpur, the same has not yet been disposed of. The details have been given in proforma, which has been brought on record by way of Annexure-3, from which it appears that the case number has been given as 706/2018-19. It is noteworthy that Bihar Right to Public Services Act has been enacted in 2011 to provide for delivery of notified public services for the people of the State within the stipulated time limit. Under the said Act, Rules have been framed, namely,

Patna High Court CWJC No.4633 of 2019(3) dt.08-03-2019 2/2 Bihar Right to Public Services Rules, 2011. By a separate notification dated 23.12.2013, time limit has been prescribed for disposal of such services, which have been notified to be public services. Disposal of an application for mutation has also been treated to be a public service.

I direct, therefore, that the Circle Officer must dispose of the petitioner's application, if not disposed of till date within the time limit as prescribed in the said notification dated 23.12.2013. I also direct the District Magistrate, Bhojpur, to examine whether inaction on the part of the Circle Officer warrants any disciplinary action against him for failure on his part to dispose of petitioner's application for mutation. Let a copy of this order be communicated to the District Magistrate, Bhojpur forthwith.
