JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2019 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in a case registered under Sections 324, 326, 307, 302, 120(B)/34 of the Indian Penal Code.
Allegation is that accused Krishna Yadav was throwing the nephew of the informant, namely, Golu Kumar out of shop of Anil Yadav after striking on his head by a spade. When the informant was lifting up his nephew, he saw that Anil Yadav and his son Arvind Yadav threw Chhotu Kumar from the shop after striking on his head with a spade and Sunil Yadav stroked on the head of Lalsi Devi with a sapde, due to which she fell down on the road. Patna High Court CR. MISC. No.16113 of 2019(5) dt.23-07-2019 2/3 Kumari and Sunita Devi, due to which they fell down on the road. Injured Lalsi Devi and Chhotu Kumar died at the spot and other injured were taken to the Hospital, where Golu Kumar died.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The allegation of assault upon the deceased is alleged against co-accused Krishna Yadav, Anil Yadav, Arvind Yadav and Sunil Yadav. Three persons have been done to death in the present case. The petitioner is a lady. There is no allegation of assault alleged against the petitioner upon the deceased. No injury is inflicted by the petitioner upon the deceased.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Rohtas at Sasaram in connection with Tr.
