Mr. Sri Dashrath Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 11-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Garkha P.S.Case No. 376 of 2017 registered under Sections 307, 323, 341, 504 and 506/34 of the Indian penal Code.
Allegation in brief is that accused persons including the petitioner armed with gun shot at the informant's brother Jitendra Ram twice, which hit on the chest of his brother and second also caused injury to the informant.
Submission is that petitioner has been falsely implicated in this case as one of the co-accused Bittu Kumar had illicit affair with the daughter of the informant and so earlier Bittu Kumar and Chandan were assaulted thereafter lodged this case falsely.
Whereas learned counsel for the State submits that it was
Patna High Court Cr.Misc. No.21180 of 2018(2) dt.11-04-2018 2/2 a retaliatory action by the petitioner and firearm injury was found on the person of the informant's brother and the informant.
Having considered the aforesaid facts and circumstances, presently the prayer of bail of the petitioner is rejected. Petitioner may renew prayer of bail after nine months, if trial is not concluded within the said period. (Arun Kumar, J) sujit/- U T
