JUSTICE ARUN KUMAR ORAL ORDER 16-03-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Parsauni P.S.Case No. 71 of 2017 registered under Sections 302 and 379/34 of the Indian penal Code.

Allegation in brief is that due to land dispute Sri Niwas Chaudhary along with his two sons intercepted the deceased on the way and Sri Niwas Chaudhary stabbed him to death. Submission is that there is specific allegation against Sri Niwas Chaudhary and petitioner is not named in the FIR and only material transpired during course of investigation against the petitioner is that SIM of the deceased was being used in his mobile and he has not criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Alok Kumar, is directed to be released on

Patna High Court Cr.Misc. No.7572 of 2018 (3) dt.16-03-2018 2/2 bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Sitamarhi in connection with Parsauni P.S. Case No. 71 of 2017. (Arun Kumar, J) Sujit/- U T
