This application is for grant of regular bail in connection with Bidupur P.S.Case No.231 of 2015, registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.

The petitioner is husband and the case is of dowry death.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case as no such occurrence has taken place and realizing this aspect of the matter, the informant has also filed a petition before the court of C.J.M. that due to confusion, present case has been lodged. The petitioner is in custody for about nine months.

Having heard both sides and in view of the nature of allegation and the petitioner is husband, I am not inclined to grant bail to the petitioner, however, as the petitioner is in custody for about nine months, the learned trial court is directed for commitment of the case and also after commitment, expedite the trial of the case.

With the aforesaid observation, this application is dismissed.
