JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 17-02-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Rajpur P.S. Case No. 236 of 2017 registered under Sections 363, 366 and 504/34 of the Indian Penal Code. The accusation is that wife of informant, Mala Devi, was accompanied by petitioners and one Dharmawati Devi for providing the job in Februrary, 2017, but his wife did not return. The informant raised suspicion against the petitioners and Dharmawati Devi about kidnapping of his wife. Learned counsel for the petitioners submits that petitioners and the informant are co-villagers. In fact, wife of the informant committed embezzlement of Rs.20,000/- from

No.8862 of 2018 (2) dt.17-02-2018 Ambedkar Samuh due to that reason she left the village then the villagers started to give pressure upon the informant due to that reason the informant lodged the present case with false allegation. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Rajpur P.S. Case No. 236 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
