Learned counsel for the petitioner produces certified copy of the order dated 4.2.2016 passed by the learned Additional Sessions Judge, Nalanda at Biharsharif in ABP No. 114 of 2016 whereby prayer for bail of the petitioner was rejected. Let it be kept on record.

The petitioner is apprehending arrest in a case registered for the offences punishable under sections 171(3),272,273,419,420,467,468,471 and 188 of the Indian Penal Code and section 47(a) of the Excise Act.

Three thousand bottles of beer total 1950 liters were

Patna High Court Cr.Misc. No.12568 of 2016 (2) dt.17-03-2016 2/2 seized from a Tata Pick-up van when a person sitting beside the driver of the vehicle namely Vinay Kumar was apprehended who suggested that the beer belonged to the petitioner and produced the documents to that effect before the informant though the documents produced have not been verified.

It is submitted by the learned counsel for the petitioner that the petitioner was not present at the place of seizure and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioner surrenders within six weeks from today in connection with Giriyak P.S. Case No. 269 of 2015 pending in the court of learned CJM, Nalanda at Biharsharif. This application is disposed of with the aforesaid observation/direction.
