JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Patliputra P.S. Case No. 121 of 2017 giving rise to Special Case No. 52 of 2017 instituted for the offence under Sections-3, 4, 5, 6, 7 of Immoral Traffic Act, u/S 20/22 of NDPS Act and under Sections-467, 468, 420, 294 , 34 of the Indian Penal Code.

As per allegation in the written report, police raided the hotel namely R.D. Inn situated in Mohalla Gosai Tola on the complaint that hotel management is running Sex racket and, recovered several objectionable articles along with Ganja as mentioned in the written report. It is further alleged that one, Punam Bhatia was running his business with the help of other accused persons as well as hotel management. Accordingly, the

It has been submitted on behalf of the petitioner that two mobile phones and Rs 500/- notes were recovered from his possession. He has no concern with the activities being done in the hotel.

Learned APP after perusal of the case diary has submitted that the petitioner was manager of the hotel. From the written report, it appears that there is no allegation of specific overt act against the petitioner. In such circumstances, prayer for bail is allowed and it is ordered that the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patliputra P.S. Case No. 121 of 2017 giving rise to Special Case No. 52 of 2017 to the satisfaction of learned Special Judge, Patna subject to condition that both the bailors should be relatives of the petitioner.
