ANJANA MISHRA ORAL ORDER 12-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Akbar Nagar P.S.Case No.32/15 for the offence under Section 366(A) of the I.P.C.

Today a supplementary affidavit is being filed bringing on record the statement of the victim girl who has now since been recovered and has made a statement under Section 164 Cr.P.C. wherein the victim girl,namely, Shivani Kumari has categorically stated that she had left her home with Rahul Kumar with whom she married and she has been blessed with a baby of one month.

In view of the aforementioned statement of the victim girl herself, let the petitioner, abovenamed, in the event of

Patna High Court Cr.Misc. No.10169 of 2016 (2) dt.12-05-2016 2/2 his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., bhagalpur, in Akbarnagar P.S.Case No.32/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
