The petitioner seeks bail in Ara Town P.S. Case No. 166 of 2017 registered under Section 30(A) of Excise Act. As per the prosecution case, 55 pouch of wine each containing 200ml was recovered from the possession of the petitioner and other co-accused on Boring situated behind Ahirpurwa Zahur ITI.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has no criminal antecedent. He has been falsely implicated in this case. The petitioner has been languishing in custody since 29.03.2017. Considering the facts aforesaid, the above named

No.28886 of 2017 (2) dt.03-07-2017 2/2 petitioner is directed to enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge, Bhojpur in connection with Dehri Ara Town P.S. Case No. 166/2017.
