JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Fatehpur PS Case No. 419 of 2017 registered under Sections 406, 409, 420/34 of the IPC and Section 7 of the E.C.Act.

The allegation in brief is that from the pick-up van in front of PDS shop of Umesh Manjhi, another co-accused, 40 bags of rice each containing 50 K.G. to be distributed in the PDS shop was recovered.

Learned Counsel for the petitioner submits that the recovery has been made from near in front of the PDS shop of Umesh Manjhi and he has no concern with the PDS shop and has been falsely implicated only because he is brother of Umesh Manjhi. He is in custody since 8.12.2017.

Having considered the said facts and circumstances, the petitioner, namely, Dinesh Manjhi is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gaya in connection with Fatehpur PS Case No. 419 of 2017.
