2. The petitioner seeks bail in connection with G.R.P./Kiul PS Case No. 300 of 2023 instituted for the offences punishable under Sections 379 and 411 of the Indian Penal Code.
3. As per the prosecution case, two ladies were involved in committing theft of Rs. 10,000/- from the bag of the informant at the railway station.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case due to ulterior motive. Petitioner has committed no offence as alleged in the FIR. He
Patna High Court CR. MISC. No.15332 of 2024(2) dt.18-03-2024 2/3 submits that the petitioner and informant was coming from Bhagalpur and due to seating arrangement in the train this false case has been instituted against the petitioner. He next submits that the seizure list witnesses are outsides and not the local people. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is a lady and is in custody since 18.11.2023.
5. Learned APP opposes the prayer for bail.

From perusal of the FIR, seizure list and impugned order of the learned Additional District and Sessions Judge-I, Lakhisarai dated 29.01.2024, it appears that total cash Rs. 10,000/- has been recovered from the conscious possession of the petitioner but there is no identification regarding cash amount and the seizure list witnesses are outsiders, accordingly the prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail after framing of charge on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Kiul (Lakhisarai) in connection with G.R.P./Kiul PS Case No. 300 of 2023.
7. The trial Court is directed to conclude the proceeding of framing of charge according to law within a
Patna High Court CR. MISC. No.15332 of 2024(2) dt.18-03-2024 3/3 period of 15 (fifteen days) from the date of receipt of a copy of this order. However, it is made clear that if the charge-sheet has not been submitted then the petitioner shall be released on bail on above conditions and he shall be present physically on each and every date before the Trial Court till conclusion of the proceeding of framing of charge.
