JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-06-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner seeks bail in connection with Sandesh P.S. Case No. 253 of 2019, registered under Sections 341, 323, 325, 307, 504 and 506/34 of the Indian Penal Code. The accusation is that in the evening of 06.10.2019, Amarjeet Kumar Nat @ Amarjeet Nat (Petitioner) was creating nuisance in drunken state, in the meantime, Dharmendra Kumar, brother of the informant Pushpraj Kumar, came out from the house and forbade him. Thereafter, petitioner started to commit Marpit with him. When informant rushed in rescue of his brother then he also started Marpit with the informant. In the meantime, Bittu Nat and Suresh Nat also came there having armed with Lathi and Danda and started to

Learned counsel for the petitioner submits that, in fact, the occurrence of Marpit took place due to petty dispute in which petitioner's side also sustained injury regarding which Sandesh P.S. Case No. 255 of 2019, under Sections 341, 323, 324, 325, 307, 504 and 506/34 was instituted on 10.11.2019. The petitioner has no criminal antecedent and he is in custody since 17.11.2019 and on investigation, the Police has submitted Chargesheet.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sri Sushant Kumar, J.M.1st Class at Ara in connection with Sandesh P.S.
