This is an application for grant of regular bail in connection with Naya Ram Nagar P. S. Case No. 10 of 2002 registered for the offences punishable under Sections 147, 148, 149, 353, 307, 188 and 160 of the Indian Penal Code and 27 of the Arms Act.
Allegation against petitioner is that he along with his associates by resorting firing was trying to capture booths for casting votes in favour of Sadhana Devi, wife of petitioner. It is submitted by the learned counsel for the petitioner that he has falsely been implicated in the case. Allegation against petitioner is general and omnibus. No incriminating article has been recovered from the possession of petitioner. Only on suspicion he has been made accused in the
Patna High Court Cr.Misc. No.14080 of 2018(3) dt.05-04-2018 2/2 present case. He is in custody since 21.7.2017. It is further submitted that similarly situated co-accused persons have been granted bail by different Benches of this Court as would appear from Annexure-2 series of this petition.
Considering the facts and circumstances of the case, let above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge Ist, Munger, in connection with S.C. No. 327A/14 arising out of Naya Ram Nagar P.S. Case no. 10 of 2002.
