The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a), 41(i) and 32 of the Bihar Prohibition and Excise Act. It is a case of recovery of illicit liquor from the pick up van.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that he has no concern with the seized liquor and the vehicle and no incriminating article has been recovered from the conscious possession of the petitioner and petitioner has not been arrested at the spot. Petitioner has clean antecedent. Learned APP appearing for the State opposed the
