2. The petitioner has prayed for bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

3. The prosecution case in short is that there is allegation of looting Rs. 3,40,000/- from Hero Motorcycle Agency of the informant by five unknown criminals.

4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner is not named in the present case but on same day his name appeared in Motipur PS Cae No. 219 of 2020. No incriminating article has been recovered from possession of the petitioner. Patna High Court CR. MISC. No.13740 of 2023(6) dt.20-09-2023 2/2 been enlarged on bail by another coordinate Bench of this Court vide order dated 1.12.2021 passed in Cr. Misc. No. 33899 of 2021. Petitioner is in custody since 8.9.2020.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.D.J. 20th, Muzaffarpur in connection with Motipur P.S. Case No. 218 of 2020.
