Petitioner seeks bail in a case registered for the offences punishable under Sections 20(B)(ii)(C) and 22(C) of the Narcotic Drugs and Psychotropic Substances Act, 1985. About 25 kilograms of Ganja was allegedly recovered from the vehicle of which the petitioner was driver. Petitioner is in custody since 04.08.2016.
Earlier prayer for bail was refused on 06.03.2017 in Cr. Misc. No. 55316 of 2016, vide Annexure-2 with liberty to renew the prayer for bail if the trial is not concluded within one year from the date of order.
Submission is that trial has not concluded nor there is chance of conclusion in near future which would be
Patna High Court Cr.Misc. No.17922 of 2018 (2) dt.18-04-2018 2/2 evident from the last order of the court below. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Udwant Nagar Police Station Case No. 295 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
