The petitioner is languishing in custody for the offences punishable under Sections 20/22 of the N.D.P.S. Act. Submission is that petitioner was apprehended on suspicion that he was escorting the four wheeler from which 32 kg of Ganja was recovered. The petitioner was on a motorcycle. Further submission is that the driver of the vehicle was allowed bail by this Court for the reason that owner of the vehicle, namely, Fudan Mahto, was found sitting at the back seat along with Ganja. Hence, He had no knowledge as to what the owner was carrying .

Considering the aforesaid facts, the statement of the

Patna High Court CR. MISC. No.13943 of 2019(3) dt.13-05-2019 2/2 petitioner on oath that he has got no criminal antecedent and completion of investigation of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Mokama P.S. Case No.205 of 2018 (Special Case No.84 of 2018), with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below having immovable property in his name.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
