NILU AGRAWAL ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner is languishing in custody since 25.06.2016 in connection with Wazirganj (Tankuppa) P.S. Case No. 214/16 for the offences alleged under Sections 25(1B)a/26/35 of the Arms Act. The prosecution case is that the police on a tip off apprehended the petitioner and two other persons and from the possession of the petitioner one live cartridge and Rs. 6000/- cash was recovered.
It has been submitted by the learned counsel for the petitioner that he is innocent and has falsely been implicated in the aforesaid case because of the past criminal antecedent. He submits that another co-accused apprehended along with the
Patna High Court Cr.Misc. No.17414 of 2017 (4) dt.20-06-2017 2/2 petitioner with one live cartridge, has since been granted the privilege of bail by a Coordinate Bench of this Court in Cr. Misc. No. 4070/2017 on 20.02.2017.
However, learned A.P.P. for the State opposes the prayer for bail stating therein that many cases of similar offences are pending against the petitioner.
Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the ACJM-I, Gaya in connection with Wazirganj (Tankuppa) P.S. Case No. 214/16, subject to the condition that the petitioner will appear before the learned Court below on each and every date and failure to appear on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
