The petitioner seeks bail in a case registered for offences under Sections 272, 273 and 308 I.P.C and Sections 30, 36 and 38 of Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, 2616 liters of foreign liquor was recovered from the orchard of one Barku Singh. It is further contended that the petitioner was not apprehended form the spot and he has been falsely implicated in this case merely on suspicion as also he has nothing to do with the alleged recovered liquor. The Charge-

Patna High Court Cr.Misc. No.20415 of 2018(2) dt.19-04-2018 2/2 sheet/prosecution report has already been submitted in this case. It is also contended that the petitioner has been implicated in another case, i.e., G.B Nagar P.S. Case No. 161 of 2017 under Section 302/34 I.P.C. Petitioner claims that he is having clean antecedent and is in custody since 23.12.2017.

Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge, Siwan in connection with G.B Nagar P.S. Case No. 152 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
