Heard the parties.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

Liquor was recovered from the house of the petitioner. Petitioner has got an identical criminal antecedent. Considering presumption of law under Section 32 and consequent bar of prayer for anticipatory bail under Section 76(2) of the Bihar Prohibition and Excise Act, I am not inclined to enlarge the petitioner on anticipatory bail in connection with

Patna High Court CR. MISC. No.23690 of 2021(2) dt.01-12-2021 2/2 Excise Case No. 408 of 2020.

Hence, prayer is refused.

Petitioner is directed to surrender within two weeks and pray for regular bail.
