JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 307, 504 and 379/34 of the Indian Penal Code and Section 25 of the Arms Act.
The accusation against the petitioner is of assaulting the informant with sword on the head and caused injury with firearm. It is submitted by learned counsel for the petitioner that no firearm injury has been found on the person of the informant. Though, injury inflicted with sword on the head has been found to be grievous but there is counter version of the occurrence also and wife of the petitioner also received injury.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.8477 of 2015 (2) dt.27-02-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sahebganj P.S. Case No. 267 of 2014 pending in the court of learned SDJM, West Muzaffarpur. Accordingly, the application is disposed of.
