Petitioner seeks regular bail in connection with Atri PS Case No. 411/2021 registered for the offence punishable under Sections 30(a) of Bihar Prohibition & Excise (Amendment) Act, 2018.
Allegedly, 10 Litres of country made illicit liquor kept in a plastic gallon has been recovered from the house of the petitioner.
Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated on the basis of statement made by local Chowkidar. He next submits that the house, from where illicit liquor has been recovered, is a joint family house
Patna High Court CR. MISC. No.12976 of 2022(2) dt.25-05-2022 2/2 and other family members also reside there and no illicit liquor has been recovered from his conscious possession. He next submits that petitioner is in custody since 22.12.2021. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the petitioner is in custody since 22.12.2021, the house, from where illicit liquor has been recovered, is a joint family house and other family members also reside there and no illicit liquor has been recovered from his conscious possession, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Court No.1, Gaya in connection with Atri PS Case No. 411/2021.
