The petitioner apprehends his arrest in a case under Section 498(A) of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
The complainant made allegation against the petitioner that the petitioner subjected her to physical and mental torture. On the basis of the complaint filed by the complainant, bearing C.R. No. 564/2010, the police instituted a case, bearing Bheja P.S. Case No. 39 of 2010. The police, after investigation, submitted final form finding the case false. The complainant filed protest petition and the case proceeded on protest. The petitioner is claiming to have divorced his wife prior to institution of the case.
Patna High Court Cr.Misc. No.16195 of 2015 (3) dt.01-05-2015 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender in the court below within four weeks from today, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jhanjharpur, District Madhubani in C.R. No. 69/2012, corresponding to T.R. No. 2430/2012, arising out of Bheja P.S. Case No. 39 of 2010, subject to the conditions as laid down under Section 438(2) Cr.P.C.
