The petitioner seeks bail in connection with Hussainganj P.S. Case No. 190 of 2016, registered under Section 302/34 of the Indian Penal Code.
The allegation of informant Rani Devi is that on 19.09.2016 a mobile call was received by her husband about committing murder of her mother Siya Devi by pressing her neck. Thereafter, she along with her husband went to her Mayaka and found the door of the house opened and her mother was lying on the cot sustaining sign of pressing on her neck and the household articles were scattered hither and thither. It is alleged that petitioner approached her mother to keep 10
Patna High Court Cr.Misc. No.27928 of 2017 (3) dt.26-07-2017 2/2 boxes of wine in her room saying that he will pay Rs. 200/- per day for keeping the wine, but her mother refused to do so, thereafter, petitioner was ready to assault her mother, therefore, the informant raised suspicion about having hand of the petitioner in the murder of her mother.
Learned counsel for the petitioner submits that it would appear from the perusal of the record that none has seen the occurrence and only suspicion has been raised by the informant having hand of the petitioner in the murder of her mother, later on, Police got recorded the confessional statement of the petitioner showing his involvement in the present case. The petitioner is in custody since 20.09.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Hussainganj P.S. Case No. 190 of 2016.
