JUSTICE BIRENDRA KUMAR ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201/34 of the Indian Penal Code, Sections 27, 25(1-b)a, 26, 27 and 35 of the Arms Act. The petitioner is not named in the FIR relating to an occurrence of murder. A mobile phone of the victim was recovered from possession of the petitioner. Hence, the petitioner is under suspicion.

The petitioner has stated on oath that he has got no criminal antecedent. He is in custody since 10.09.2017. There is no eye-witness of the occurrence. Investigation is already complete and he is ready to cooperate with the trial. Considering the entire facts aforesaid, let the

No.11431 of 2018 (2) dt.28-02-2018 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Dhamdaha Police Station Case No. 192 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
