JUSTICE DINESH KUMAR INGH ORAL ORDER 08-03-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 47(a) of the Excise Act. From the house of the petitioner, 35 liters of country made liquor were recovered.
It is submitted by learned counsel for the petitioner that recovery has been made from the joint family house and the seizure list does not bear the signature of the petitioner. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts constitute good ground for consideration of prayer for regular bail.
Let the learned court below consider the prayer for
Patna High Court Cr.Misc. No.10457 of 2016 (2) dt.08-03-2016 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Sarai P.S. Case No. 198 of 2015 pending in the court of learned CJM, Vaishali at Hajipur. Accordingly, the application is disposed of.
