JUSTICE SHIVAJI PANDEY ORAL ORDER 20-08-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in Aurangabad (Mufassil) P.S. Case No. 125 of 2016 registered for offence punishable under Sections 392 and 412 of the Indian Penal Code.
The allegation against the co-accused including the petitioner is to have looted the truck on the point of pistol and snatched the mobile phones of driver and Khalasi, however, counsel for the petitioner submits that the petitioner is not named in the FIR. During investigation, the name of the petitioner has come in the confessional statement of co-accused Mubark Ali, who happens to be the father of the petitioner and the said Mubark Ali has been granted bail by this Court and the
Patna High Court CR. MISC. No.11330 of 2020(4) dt.20-08-2020 2/2 petitioner is in custody since 13.01.2020.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Aurangabad (Mufassil) P.S. Case No. 125 of 2016 subject to condition that one of the bailor will be the close relative of the petitioner and further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
